This Rental Agreement (“Agreement”) is made and entered into by and between Belloise Real Estate, Inc., DBA Florida Vacation Rental Company (“FVRCO”), and [GUEST NAME] (“Guest”) for the rental of the vacation property detailed in the reservation. The terms and conditions outlined herein are legally binding upon electronic endorsement of this Agreement, either with electronic signature or by checking the “I Agree” box during the online checkout process.
RENTER REQUIREMENTS
For legal and accounting purposes, the individual making the reservation must be the credit/debit cardholder and will be considered the “Guest.” All other persons associated with the reservation will be considered the Guest’s invitees. Communication concerning the reservation, including cancellation and damage policies, will be conducted exclusively with the Guest.
AGE REQUIREMENT
FVRCO will not rent to individuals under 25 years of age, and someone 25 years of age or older must be present for the duration of the reservation. Reservations made under false pretenses will result in eviction and forfeiture of any payments made.
PHOTO IDENTIFICATION
Guests are required to provide a valid photo identification (driver’s license, passport, or other government-issued ID) prior to receiving check-in information. FVRCO reserves the right to withhold check-in details until valid ID is received.
PAYMENT TERMS
Non-Refundable Policy
All payments made to FVRCO or collected via third-party booking platforms are non-refundable under any circumstances. Guests were provided the option to purchase travel insurance at the time of booking and are encouraged to seek additional travel insurance coverage from third-party providers to protect against unforeseen events. FVRCO does not offer refunds or compensation for any reason, including but not limited to: acts of nature, weather conditions (including hurricanes), states of emergency, mandatory evacuations, or other unforeseen circumstances. This policy supersedes any refund or cancellation policies provided through third-party booking websites, including, but not limited to, Airbnb, VRBO, and Booking.com.
Payment Schedule
When reserving a stay greater than 60 days in advance from check-in, the initial non-refundable deposit is 40% of the total reservation cost. The final balance for the rental is due 60 days prior to the scheduled arrival date and will be automatically charged to the card on file. Accepted forms of payment include MasterCard, Visa, American Express, and Discover. FVRCO does not accept cash, checks, or money orders. Failure to pay the balance prior to the 60-day deadline will authorize FVRCO to charge the card on file for the remaining balance. If FVRCO is unable to successfully charge the card on file according to the aforementioned deadlines, the Guest’s reservation will be subject to cancellation without refund.
When reserving through third-party reservation websites, alternative payment schedules might apply.
Additional Charges
The following fees apply for early check-in and late check-out by request:
- Standard Homes: $36 per hour plus tax, with a maximum of four (4) hours that can be added.
- Large Homes (5+ bedrooms): $100 per hour plus tax, with a maximum of four (4) hours that can be added.
- Clearwater Beach Suites: $50 per hour plus tax, with a maximum of four (4) hours that can be added.
Guests requiring more than four additional hours must book an extra full night at the current dynamic pricing rates. Failure to vacate the property on time may result in charges at the hourly rates mentioned above. If guests do not leave by 2:00 PM without prior arrangements, they will be charged for an additional full night at the current dynamic pricing rate.
CANCELLATION POLICY
FVRCO does not provide refunds or reimbursements for cancellations, flight disruptions, early departures, or events beyond its control, including but not limited to weather conditions, natural disasters, hurricanes or named storms, power outages, or governmental actions (e.g., mandatory evacuations or states of emergency). Guests are encouraged to purchase third-party travel insurance to protect their reservation funds. This policy supersedes any refund or cancellation policies provided through third-party booking websites, including, but not limited to, Airbnb, VRBO, and Booking.com.
RATES
Once the reservation has been made, the rates associated with the booking will remain the same. However, any additional services or nights added to the booking are subject to FVRCO’s dynamic pricing system and may be priced differently from the original reservation. Unbooked nights are subject to price changes at any time.
THIRD-PARTY TRAVEL INSURANCE
The Guest was offered the option to purchase travel insurance at the time of booking, and is strongly encouraged to seek third-party travel insurance. Travel insurance is recommended as it can provide protection for the Guest’s reservation funds against unforeseen circumstances that may impact their stay. These circumstances can include, but are not limited to, unexpected illnesses, accidents, family emergencies, severe weather events, and mandatory evacuations due to natural disasters.
FVRCO is not an insurance provider and does not directly manage travel insurance policies. Any travel insurance options presented through our office are serviced by an independent, third-party provider.
Travel insurance is the only method to safeguard Guest reservation funds as FVRCO does not offer refunds for cancellations, early departures, or interruptions due to such events. By opting for third-party travel insurance, Guests can minimize their financial risk and ensure peace of mind when planning their stay.
MANDATORY EVACUATION POLICY
In the event of a mandatory evacuation order, the Guest is not entitled to any refund, reimbursement, or compensation from FVRCO. FVRCO strongly recommends that the Guest purchase third-party trip cancellation and interruption insurance to protect against financial loss under such circumstances. Should the Guest choose not to secure third-party insurance, they do so at their own risk.
This policy supersedes any refund or cancellation policies provided through third-party booking websites, including, but not limited to, Airbnb, VRBO, and Booking.com.
ARRIVAL AND DEPARTURE
- Standard Check-In Time: 4:00 PM
- Standard Check-Out Time: 11:00 AM for single-family homes, 10:00 AM for condominiums. Unauthorized late departures may result in additional fees.
Guests may request early check-in or late check-out, subject to additional fees, availability and approval. Any such requests must be made at least 2 business days prior to arrival or departure.
KEY PROCEDURES
Most FVRCO rentals use a keyless entry system. Guests will be provided with an access code via email or SMS message shortly after the check-in time of 4:00 PM. By signing this Agreement, the Guest consents to receive electronic communications via email and SMS for the purposes of check-in instructions, reservation updates, and other communications related to the stay.
For rentals with traditional keys, key pickup will be at the FVRCO office. Instructions will be provided via email on the day of check-in.
LOCKOUT EMERGENCIES
In the event of a lockout or an issue with an electronic lock system, Guests should immediately contact FVRCO via phone call for the fastest response. Communication through text message, email, or third-party messaging platforms may result in delayed assistance. A reasonable response time is defined as within 5 hours of receiving notice of the lockout or lock failure.
If the lock’s battery dies or the lock malfunctions, FVRCO will dispatch assistance. No refunds or compensation will be provided for lockout issues that are resolved within the reasonable response time outlined. It is the Guest’s responsibility to ensure that electronic locks are properly secured and used according to the manufacturer’s instructions during their stay.
SECURITY & SAFETY RISKS
Guests are responsible for locking doors and windows at all times during their stay, especially when leaving the property unattended. FVRCO is not liable for the loss, damage, or theft of personal property during the Guest’s stay. Children must be supervised at all times, and candles are strictly prohibited due to fire hazards.
FVRCO, the property owner, and the homeowner’s association or co-op are not responsible for injuries or accidents that may occur on the premises, including slips, falls, or accidents due to uneven footing or stairs. By signing this Agreement, the Guest assumes all liability for themselves and parties to their reservation and agrees to hold FVRCO, the property owner, and the homeowner’s association or co-op harmless for any injuries or damages.
MAXIMUM OCCUPANCY RESTRICTION
The maximum number of guests allowed to occupy the rental property is strictly limited to [PROPERTY LIMIT] guests. This occupancy limit is enforced to ensure the safety, comfort, and enjoyment of all guests and to maintain the condition of the property.
Exceeding the maximum occupancy without prior written approval from FVRCO is considered a violation of this agreement and may result in additional charges, immediate eviction without refund, and liability for any damages or disturbances caused.
Guests must accurately disclose the names and number of additional occupants in this Agreement and inform FVRCO of any changes before arrival. The Guest agrees that no more than the number of persons listed in this Agreement shall occupy the premises without prior approval from FVRCO. Unauthorized guests may result in additional charges, eviction, or both.
If there is any change in the number of guests before or during the stay, the Guest must notify FVRCO in advance. No refunds or adjustments will be made for changes in the number of guests after arrival.
EVENTS AND PARTIES
Events, parties, and gatherings of any kind are strictly prohibited on the rental premises unless express, written approval has been provided by FVRCO. Any unauthorized event or party will be considered a violation of this contract and may result in immediate eviction without refund, as well as additional charges for any damages, disturbances, or cleaning fees incurred. If excessive noise, illegal activity, or any violation of these policies occurs, FVRCO reserves the right to evict the Guest and their invitees without refund and impose additional charges.
To request permission for an event or gathering, the Guest must contact FVRCO directly for prior approval. Approval is granted solely at FVRCO’s discretion and may include additional terms and fees.
WHAT IS INCLUDED IN YOUR RENTAL
FVRCO provides the following items for guest use:
- One roll of toilet paper per bathroom.
- One roll of paper towels in the kitchen.
- Bed linens and pillows.
- Beach towels.
Certain properties are equipped with:
- Dishwasher.
- Washing machine.
- Dryer.
The following items are generally not provided in the rental:
- Beach chairs, umbrellas, bicycles.
- Food, including condiments and seasonings.
- Laundry detergent, dishwashing detergent, soaps or shampoos.
- Cribs, highchairs, air mattresses.
Guests may request cribs, highchairs, or rollaway beds to be pre-delivered to the rental for an additional charge via third-party companies. Please contact FVRCO in advance to make arrangements.
HOUSEKEEPING
A one-time housekeeping fee is included in the reservation. The rental property will be cleaned before the Guest’s arrival and after their departure. If there are any housekeeping concerns upon arrival, Guests must notify FVRCO within four (4) hours after the scheduled check-in time. If notified within this timeframe, a housekeeper will be sent to address concerns as soon as possible and at no additional charge. After this timeframe has expired, Guests will be responsible for additional cleaning fees if they would like a housekeeper to be sent. No refunds, reductions in rent, or compensation will be provided for housekeeping concerns that can be remediated within 24 hours of notice. No refunds, reductions in rent, or compensation will be provided in the event Guest refuses housekeeping remediation or does not notify FVRCO within the aforementioned time period.
Guests are responsible for their own personal laundry and any mid-stay cleaning. The following housekeeping rules apply:
- Guests do not need to strip the beds; housekeeping will handle this upon your departure.
- Dirty dishes should be placed in the dishwasher and the dishwasher started before checkout.
- Guests are requested to remove all garbage from the rental and place it in outdoor garbage containers.
- All food should be removed from the refrigerator and freezer. Do not leave any sugary items as they may attract pests.
- If excessive trash or mess is left behind, guests will be assessed additional fees up to $1,000 for extra labor.
PARKING
Parking at the rental property is limited and specific to each unit. Guests are required to park only in designated areas. In properties where a parking pass or decal is required, the Guest must ensure that it is properly displayed at all times to avoid towing. FVRCO is not responsible for any towing fees, damages, or fines resulting from improperly parked vehicles or failure to display a parking pass as required.
No parking of boats, jet skis, trailers, or RVs is permitted unless specifically authorized in writing by FVRCO. Guests assume full responsibility for their vehicles and any associated damages or fees incurred during their stay.
PROPERTY CONDITION & REPAIRS
Guests agree to report any issues with the property immediately upon discovery. No refunds or compensation will be provided for maintenance issues that can be addressed in a reasonable timeframe from FVRCO’s confirmation of receipt of Guest’s notice. “Reasonable timeframe” is defined as within 48 hours during weekdays or 72 hours on weekends.
FVRCO reserves the right to enter the property at any time without prior notice or Guest approval to inspect the premises or perform necessary repairs, with efforts made to conduct these activities during reasonable hours to minimize disruption.
DAMAGE POLICY
As a condition of this Agreement, the Guest agrees that FVRCO may charge their card for any damages or losses incurred during the rental period caused by the Guest or their invitees. This includes, but is not limited to, damage to the property, excess cleaning requirements, fines, service calls, or any repair or replacement costs. FVRCO will provide documentation of damages and charges upon request.
Accidental Renter’s Damage Protection (ARDP)
A one-time ARDP fee is included in the reservation. This fee covers accidental damage to the rental property up to $500 if charged $49.00, or $1,000 if charged $69.00. Should damages exceed this amount or fall outside of the ARDP coverage, the Guest authorizes FVRCO to charge the Guest’s card for the costs of repairs or replacements. ARDP does not cover:
- Acts of God
- Gross negligence or intentional acts
- Willful destruction of property
- Normal wear and tear
- Theft
- Guest’s personal property
- Rental vehicles
- Trip cancellation or delay
- Cleaning fees
- Property damage caused by motorized vehicles
PLUMBING RESTRICTIONS
Guests are strictly prohibited from flushing any items other than toilet paper down the toilets. This includes, but is not limited to, items marketed as “flushable” wipes, baby wipes, paper towels, tissues, feminine hygiene products, cotton swabs, and any other non-degradable materials. Disposal of these items in toilets can lead to severe plumbing blockages, backups, and damage.
The Guest will be held financially responsible for any plumbing repairs, damages, or additional cleaning services required as a result of improper disposal of items. FVRCO reserves the right to charge the Guest’s card on file for all costs associated with resolving plumbing issues caused by these prohibited actions.
PET POLICY
Unless explicitly authorized by FVRCO in writing, pets are not permitted on the property. Guests who bring unauthorized pets will be charged a $1,000 fee and are subject to immediate eviction without refund or compensation. Pet-friendly properties may require an additional $125 pet fee per pet, plus tax. Guests are fully responsible for any damages or excess cleaning fees caused by the pet, including the cost to pick up any pet waste not removed prior to departure. All dogs must be leashed at all times when outside, in accordance with City of Clearwater regulations, and must be supervised by the pet owner.
The following dog breeds are strictly prohibited:
- Pit Bull and any mix thereof
- Akitas
- Doberman Pinschers
- Chows
- Rottweilers
- Staffordshire Terriers
- American Bulldogs
- Alaskan Malamutes
- Siberian Huskies
- Mastiffs
- Wolves or Wolf hybrids
- Presa Canarios
POOLS AND HOT TUBS (IF APPLICABLE)
Pools and hot tubs, if available at the rental property, are for the use of registered Guests only. Lifeguards are not provided, and Guests are responsible for their own safety and the safety of their invitees. The following conditions apply:
- No pool or hot tub use is allowed between the hours of 10:00 PM to 9:00 AM daily.
- If the pool is heated, a pool heating fee will be disclosed at the time of the Guest’s request to use the heater. If FVRCO determines that the pool heating system was used during the Guest’s stay without prior approval, FVRCO reserves the right to charge the Guest’s credit card for the heating fee.
- FVRCO is not responsible for injuries or accidents resulting from pool or hot tub use. By signing this Agreement, Guests accept all liability for the use of these amenities.
Excessive noise, misuse of the pool or hot tub, or complaints from neighbors may result in the Guest being asked to vacate the property without refund.
MOVING FURNITURE
Furniture in the rental property may not be moved or rearranged without FVRCO’s written approval. Moving furniture may result in a fine of $500, plus the cost of any damages resulting from the move. All furniture is to remain in its designated location throughout the Guest’s stay.
PRIVATE ELEVATORS (IF APPLICABLE)
If the property includes a private elevator, the Guest is responsible for ensuring its proper use. Any service call necessitated by misuse will be charged to the Guest’s card on file.
BARBECUE GRILLS
Guests are responsible for purchasing their own charcoal or propane for any barbecue grills provided at the property. FVRCO does not provide or reimburse for charcoal or propane. Grilling must be conducted safely and not under covered areas such as porches or near walls. Hot ashes must only be disposed of once they are completely cold. Do not place hot ashes in any trash containers.
In case of emergency, please call 911 immediately.
PEST CONTROL
FVRCO employs preventative pest control measures. Due to Florida’s natural environment, the presence of pests (such as insects, ants, or rodents) may occur from time to time. If pests are noticed upon arrival or during the stay, Guests must immediately notify FVRCO. FVRCO will determine the best course of action and arrange for appropriate pest control services as necessary.
The presence of pests is not considered grounds for compensation. Refunds or reductions in rent are not provided for the presence of pests. Requests for compensation will be rejected per this clause in the contract. Guests are encouraged to take reasonable precautions, such as storing food properly and keeping doors and windows closed, to help prevent pests.
QUIET HOURS
Mandatory quiet hours are enforced daily from 10:00 PM to 9:00 AM unless otherwise posted. Pool or hot tub use during quiet hours is strictly prohibited, and excessive noise or disturbances may result in eviction without refund.
SMOKING POLICY
Smoking is strictly prohibited on the premises of all FVRCO properties. Oil lamps and incense are not permitted due to the long-lasting odor. Any evidence of smoking, including the smell of tobacco or marijuana, will result in a $1,000 fine, excess cleaning fee, and replacement cost of any smoke damaged decor.
UNAVAILABILITY
If the reserved property becomes unavailable prior to check-in due to reasons not already covered in this contract, FVRCO reserves the right to move the reservation to an alternative rental property at FVRCO’s sole discretion and without explicit approval from the Guest. If an alternative rental property is not available, FVRCO reserves the right to cancel the reservation and refund all payments made by the Guest. This refund shall be the Guest’s sole remedy in the event of unavailability.
PROPERTY SUBSTITUTIONS
While FVRCO strives to honor all specific property requests, unforeseen circumstances may necessitate substituting a comparable rental unit. In such cases, FVRCO will notify the Guest immediately and either provide alternative accommodations or offer a full refund if no suitable alternative is available.
UNITS FOR SALE
In the event that the rental property is listed for sale, FVRCO reserves the right to show the property during the Guest’s stay. Every effort will be made to schedule showings at a time that is convenient for the Guest to minimize disruption. The Guest will be provided with reasonable notice in advance of any such showing. FVRCO’s notice to Guest does not require Guest approval.
RIGHT OF ENTRY
FVRCO reserves the right to enter the property at any time, with reasonable notice, for purposes of inspection, maintenance, or to address violations of this Agreement. Reasonable notice does not require guest approval, only notification of intention to enter the premises. Notification can be made by phone call, SMS, email, or other form of messaging service.
LOST AND FOUND
FVRCO is not responsible for lost or misplaced items. Any items found will be returned upon request for a $25 handling fee plus postage.
YOU ARE RESPONSIBLE FOR YOUR CHOICE
This rental property is not owned by Florida Vacation Rental Company. The property has been described in detail to the best of FVRCO’s ability, and the Guest is responsible for making the decision to book the property. No refunds or transfers to another property will be provided if the Guest is unhappy with the property upon arrival.
INDEMNIFICATION & HOLD HARMLESS
While FVRCO and its property owners strive to maintain the rental properties in optimal condition, no guarantees, expressed or implied, are provided regarding the property’s suitability for any particular purpose. All Guests and their invitees use the property structures, premises, and amenities at their own risk.
FVRCO makes no guarantees regarding the suitability, compatibility, or performance of utilities, amenities, or materials used in the property’s construction or contents. FVRCO and its property owners shall not be held liable for any allergic reactions experienced by the Guest and/or invitees, including those triggered by materials or substances present in the property, such as mold, airborne spores, pet allergens, or chemical agents from cleaning products, appliances, linens, carpeting, fixtures, pools, hot tubs, or other items.
FVRCO and its property owners shall not be liable or responsible for any injury to the Guest and/or their invitees resulting from intentional or unintentional acts by the Guest and/or their invitees, nor from the condition, failure, malfunction, or misuse of structures, appliances (including but not limited to pools, hot tubs and BBQs), furnishings, or other equipment. This includes injuries or damages arising from acts of nature or other naturally occurring events.
The Guest shall be fully responsible for the actions, injuries, behavior, and any damages caused by their invitees while on the property. FVRCO, the property Owner(s), the Homeowners Association, Co-op, the Real Estate Company and/or Agent, and the Management Company are not responsible for any injury to the Guest, tenants, or their invitees and cannot be held liable, accountable, or responsible for such incidents. This includes, but is not limited to, injuries and medical costs resulting from slipping, falling, tripping, unlevel footing, stairs or steps, and loose railings.
The Owner(s), Homeowners Association, Co-Op, the Real Estate Company and/or Agent, and the Management Company are also not responsible for any loss, theft, or damage to the Guest’s or their invitees’ property, belongings, or personal items, whether within the rented unit or in any common property areas.
By signing this Agreement electronically or in writing, or by clicking “I Agree” during checkout, the Guest and their invitees agree to indemnify and hold harmless FVRCO, the property Owner(s), the Homeowners Association, Co-Op, the Real Estate Company and/or Agent, and the Management Company from and against any and all claims, demands, losses, liabilities, or expenses of any kind, including legal costs, arising from or connected with the Guest’s use of the property and any actions of their invitees.
By electronically signing this Agreement, the Guest affirms they have read, understood, and agree to all terms and conditions herein, including this indemnification clause.
MANDATORY BINDING ARBITRATION AGREEMENT
The Guest agrees that FVRCO cannot be sued in any court under this contract. In the event of a dispute, controversy, or disagreement arising from this contract between the Guest and FVRCO, arbitration will be the exclusive and sole remedy for resolution.
Either the Guest or FVRCO may demand arbitration to settle any dispute, controversy, or disagreement related to or arising from this contract. Both parties agree to accept the arbitrator’s decision as final and binding, serving as the first, last, and only resolution for such disputes.
The following arbitration procedures will apply:
Upon written request by either party, both the Guest and FVRCO will select an arbitrator. The two arbitrators will then jointly select a third arbitrator. If the two arbitrators are unable to agree on a third arbitrator within thirty (30) days, a judge from a court of competent jurisdiction will appoint the third arbitrator.
Each party is responsible for the costs of their selected arbitrator, while the cost of the third arbitrator will be shared equally between the Guest and FVRCO.
All other expenses incurred during the arbitration process will be borne by the party incurring them.
The arbitration will take place in the State of Florida and will be conducted in accordance with Florida law. Arbitration shall serve as the exclusive method of resolving any and all disputes, including any claims for extracontractual or punitive damages. The arbitrators’ decision shall be final, conclusive, and binding. No legal action or lawsuit may be initiated by either party except to enforce the arbitration award, as allowed under Florida law.
ENTIRE CONTRACT
This contract constitutes the entire agreement between the Guest and FVRCO regarding the Guest’s rental booking. No other promises, representations, or conditions—whether oral or written—are binding between the parties unless expressly included in this contract. This contract supersedes all prior oral or written agreements, communications, or understandings.
